Terms of Service

By accessing and using GShareKo ("Platform"), operated by GShareKo Philippines, Inc. (SEC Registration: CS202400123456), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this platform.

These terms constitute a legally binding agreement between you and GShareKo Philippines, Inc., a corporation duly organized and existing under Philippine law.

GShareKo is a digital platform that connects content creators with brands for social media marketing campaigns. The platform facilitates:

• Campaign creation and management for brands
• Creator discovery and application processes
• Content submission and approval workflows
• Secure payment processing via GCash
• Performance tracking and analytics

General Requirements:

• Must be at least 18 years of age
• Must be a Philippine citizen or legal resident
• Must provide accurate and complete registration information
• Must maintain the security of your account credentials

Creator-Specific Requirements:

• Valid Philippine government-issued ID
• Verified GCash account
• Authentic social media presence with minimum follower requirements
• Compliance with platform quality standards

Brand-Specific Requirements:

• Valid business registration (SEC/DTI)
• Authorized representative with signing authority
• Compliance with advertising standards and regulations

All Users Must:

• Provide accurate, current, and complete information
• Maintain the confidentiality of account credentials
• Comply with all applicable laws and regulations
• Respect intellectual property rights
• Not engage in fraudulent or deceptive practices
• Report any suspicious activity or violations

Creators Must:

• Create original, authentic content
• Follow brand guidelines and campaign requirements
• Disclose sponsored content as required by law
• Submit content within specified deadlines
• Maintain professional communication with brands

Brands Must:

• Provide clear, achievable campaign requirements
• Review submissions in a timely manner
• Ensure all content requests comply with platform policies
• Respect creator intellectual property rights

For Creators:

• Payments are processed via GCash within 24-48 hours of content approval
• No fees are deducted from creator payments
• Minimum payout threshold: ₱100
• Tax obligations are the responsibility of the creator

For Brands:

• Campaign funds are held in secure escrow upon campaign activation
• Platform fee of 2% applies to total campaign budget
• Payments to creators are released only upon content approval
• Unused budget is refunded within 7 business days

Dispute Resolution:

Payment disputes must be reported within 30 days. GShareKo will mediate disputes and make final determinations based on platform policies and evidence provided.

Platform Content:

All platform features, design, code, and proprietary technology remain the exclusive property of GShareKo Philippines, Inc.

User-Generated Content:

• Creators retain ownership of their original content
• Brands receive usage rights as specified in campaign terms
• Users grant GShareKo limited rights to display content for platform operation
• Users are responsible for ensuring they have rights to all content they submit

Users are strictly prohibited from:

• Creating fake accounts or providing false information
• Purchasing fake followers, likes, or engagement
• Submitting plagiarized or stolen content
• Violating any applicable laws or regulations
• Harassing, threatening, or abusing other users
• Attempting to circumvent platform security measures
• Promoting illegal products, services, or activities
• Spamming or sending unsolicited communications

GShareKo reserves the right to suspend or terminate accounts for violations of these terms, suspicious activity, or at our sole discretion. Upon termination:

• Access to the platform will be immediately revoked
• Pending payments for completed work will be processed
• Active campaigns may be cancelled
• User data will be handled according to our Privacy Policy

GShareKo Philippines, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from platform use. Our total liability is limited to the amount of fees paid by the user in the 12 months preceding the claim.

The platform is provided "as is" without warranties of any kind, either express or implied.

These terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved through binding arbitration in Metro Manila, Philippines, or through the appropriate courts of the Philippines.

GShareKo reserves the right to modify these terms at any time. Users will be notified of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the new terms.
